Divided court rejects school diversity plans - CNN.com

"A conservative majority led by Chief Justice John Roberts said other means besides race considerations should be used to achieve diversity in schools."

Solicitor General Paul Clement told the justices the two plans at issue represented "very stark racial quotas." He argued they were a "clear effort to get the schools to mimic the overall community" and that other "race-neutral" means to achieve classroom diversity should be used.

"Those who favor ignoring race as an explicit administrative matter, in the hope that it will cease to exist as a social concept, ignore the weight of a vast body of sociological research that shows that racial hierarchies are embedded in the routine practices of social groups and institutions." - The American Sociological Association

We can't commit to actually fixing the problem so we pretend it goes away, then it persists way longer than it should. The effects of slavery and segregation are still around because we used half-assed ways of fixing them and then pretended it was all ok.
